General Information
For the purposes of these terms and conditions, “THE CLIENT” shall be understood hereinafter as the person or group of people who hire the “Picnic Events” service, likewise, “THE PICNIC COMPANY”® shall be understood hereinafter as the company in charge of providing the above mentioned service, understanding that both parties accept all the terms, conditions, policies and notices set forth herein.
Condition of furniture and accessories.
All furniture, decoration, utensils, and in general all the material used for the assembly of the contracted service, are in perfect condition, therefore, “THE CLIENT” must verify it at the beginning of the service and in case of detecting any damage or missing, must point out the defects immediately so that they are repaired or replaced, or failing that it is recorded that they were received in accordance with the service, In case of damage or loss of the product during the service, “THE PICNIC COMPANY”® reserves the right to charge the value of the damages caused by “THE CLIENT” and / or his guests.
Cleaning of the furniture and accessories.
At the end of the service, “THE PICNIC COMPANY”® will check the integrity of the furniture and its accessories and in case of dirt stains on textiles (cushions, blankets, table runners, napkins, etc.), “THE CLIENT” will be charged a cleaning fee, as the case may be and in case it is not possible to remove the dirt, such charge will be for the amount equivalent to the replacement, such charge will be quanti ed depending on the material and density of the dirt in question.
Duration of the service.
The service has a duration of 2 to 4 hours, unless prior to the con rmation, extra hours have been requested, and “THE CLIENT” agrees that each extra hour will have an additional cost of $500.00 ( ve hundred pesos 00/100 national currency). If “THE CLIENT” wishes to terminate the service in advance of the agreed time for reasons beyond “THE PICNIC COMPANY”®’s control, he/she must inform via telephone at +52 322 151 8787, to advance the termination process.
Changes in the service.
Once the service is con rmed, changes may be requested up to 5 ( ve) days in advance in details such as: style, blackboard, color of cushions or decoration; likewise, changes in the number of people or guests may be requested up to 2 days before the service, changes requested 1 day in advance will not be considered by “THE PICNIC COMPANY”® for organizational and logistical reasons.
Property
The material used, as well as all components, decoration and accessories are property of “THE PICNIC COMPANY”®, for which “THE CLIENT” under no circumstances may lease, sell, assign or transfer by any means to third parties, otherwise, “THE CLIENT” shall pay all damages caused by such acts to “THE PICNIC COMPANY”® .
Use of furniture and accessories.
“The CLIENT” undertakes to use the material with due care and respect, as well as not to use it for any purpose other than exclusively for the contracted service, and it is forbidden to make changes in the assembly, decoration or theme contracted.
Responsive.
“THE PICNIC COMPANY”® assumes no responsibility in case of accidents or injuries that may arise during the service.
“THE PICNIC COMPANY”® assumes no responsibility for food intolerances or allergies.
Consumption of alcoholic beverages.
Based on Article 220 of the General Health Law, which states: “In no case and in no way may alcoholic beverages be sold or supplied to minors.” In the case of adults, the consumption of alcohol is at their own risk and “THE PICNIC COMPANY”® disclaims any eventuality or accident that may occur due to abuse in its consumption.
Photographs.
Each contracted picnic includes a package of photographs according to the contracted package: classic= 5 photographs; premium= 5 photographs; premium plus and groups= 5-10 photographs; marriage proposal= 20 photographs. These will be captured by our photographer and at the discretion of the same, will be chosen the best to deliver to “THE CLIENT”, so being a courtesy gift, this has no in uence on their selection, however, there is the possibility of hiring a photo shoot at additional cost.
Rain or fortuitous event.
In case of rain or bad weather due to storms, the client has the option to reschedule the service up to 1 day before the contracted date, in case it is foreseeable by the National Meteorological Service.
In the case of an unforeseen event, the service may be cancelled at any time and will be rescheduled according to the availability of “THE PICNIC COMPANY”® agenda, without the option of cancellation or refund.
Additional services.
Other tasks, such as special cleaning work, transportation tasks or decoration that has not been contractually speci ed, will be paid extra depending on the e ort. For events of 12 or more people, the rate increases $1,000.00 (one thousand pesos/100 Mexican pesos) due to the type of transportation required to transport the furniture.
The oral arrangements that are included in the decoration of the contracted theme, may not be modi ed or increased, in case of requiring additional ower service, this will have an extra cost, depending on the quantity, type and availability.
Intellectual Property and Copyrights.
The “PICNIC PREMIUM PLUS, MOVIE NIGHT ON THE BEACH” service, as its name indicates, consists of the projection of a lm or cinematographic creation during the event, said service is a courtesy without cost when hiring the aforementioned service, therefore, it is to make clear that “THE PICNIC COMPANY”® does not have the patrimonial rights of such lm productions, however, the same have been acquired through streaming service prior to their respective payment subscription, so it is considered for private use and non- pro t, not being included an extra fee for reproduction to “THE CLIENT” and his guests, the above according to the Federal Copyright Law and its articles relating to the total or partial reproduction of cinematographic works for non-pro t purposes.
Privacy Notice
“THE PICNIC COMPANY”® is responsible for the use and protection of your personal data, ensuring the use only for the contracted services, ensuring that at no time will be shared with third parties, and that we do not collect sensitive information at all times protecting your privacy and exclusivity, in accordance with the provisions of the Federal Law on Protection of Personal Data Held by Private Parties.
Business autonomy.
We reserve the right to refuse service to any person, for any reason and at any time, as well as to perform any work or extra time to the contracted.
Accepted methods of payment.
We currently accept payments through bank transfers, Paypal and cash. In the case of transfers and Paypal, “THE CLIENT” will be responsible for the charges applied by the nancial institutions for such service. Also, in case of requiring invoice, the corresponding VAT charge will be applied.
Accuracy, completeness and timeliness of the information
We have made the e ort to show the colors, images and assemblies of our services with the highest possible color accuracy, as well as the structure, arrangement and quality of the materials. We cannot guarantee that your computer monitor will display colors, dimensions and approaches accurately.
Noise in the environment.
Because the events are held on the beach, being a public place without access restriction, we have no in uence on the volume of external music or people’s voices, however we try to isolate the Picnic from others, as much as possible to ensure privacy and tranquility, so we are not responsible for disturbances or noises that are not within our reach.
Cancellations.
If there is a cancellation by “THE CLIENT”on the same day of the event, he/she will be subject to a penalty of $1,000.00 (one thousand pesos 00/100 national currency).
In the event that we make a change or cancel a service due to force majeure, directly attributable to “THE PICNIC COMPANY”®, we will notify you immediately, giving you the option to reschedule.
Signature.
The service contract must be signed by the client prior to the event, as it implies the express acceptance of the contracted service, as well as the present terms and conditions, in the absence of such signature, the event cannot be carried out.
