For the purposes of these terms and conditions, “THE CLIENT” shall be understood <\/span>hereinafter as the person or group of people who hire the <\/span>“Picnic Events” <\/span>service, <\/span>likewise, “THE PICNIC COMPANY”\u00ae shall be understood hereinafter as the company in <\/span>charge of providing the above mentioned service, understanding that both parties <\/span>accept all the terms, conditions, policies and notices set forth herein.<\/span><\/p>\n All furniture, decoration, utensils, and in general all the material used for the assembly of <\/span>the contracted service, are in perfect condition, therefore, “THE CLIENT” must verify it <\/span>at the beginning of the service and in case of detecting any damage or missing, must <\/span>point out the defects immediately so that they are repaired or replaced, or failing that it <\/span>is recorded that they were received in accordance with the service, In case of damage or <\/span>loss of the product during the service, “THE PICNIC COMPANY”\u00ae reserves the right to <\/span>charge the value of the damages caused by “THE CLIENT” and \/ or his guests.<\/span><\/p>\n At the end of the service, “THE PICNIC COMPANY”\u00ae will check the integrity of the <\/span>furniture and its accessories and in case of dirt stains on textiles (cushions, blankets, <\/span>table runners, napkins, etc.), “THE CLIENT” will be charged a cleaning fee, as the case <\/span>may be and in case it is not possible to remove the dirt, such charge will be for the <\/span>amount equivalent to the replacement, such charge will be quanti<\/span>\u2000<\/span>ed depending on <\/span>the material and density of the dirt in question.<\/span><\/p>\n The service has a duration of 2 to 4 hours, unless prior to the con<\/span>\u2000<\/span>rmation, extra hours <\/span>have been requested, and “THE CLIENT” agrees that each extra hour will have an <\/span>additional cost of $500.00 (<\/span>\u2000<\/span>ve hundred pesos 00\/100 national currency). <\/span>If “THE CLIENT” wishes to terminate the service in advance of the agreed time for <\/span>reasons beyond “THE PICNIC COMPANY”\u00ae’s control, he\/she must inform via telephone <\/span>at +52 322 151 8787<\/span>, to advance the termination process.<\/span><\/p>\n Once the service is con<\/span>\u2000<\/span>rmed, changes may be requested up to 5 (<\/span>\u2000<\/span>ve) days in advance <\/span>in details such as: style, blackboard, color of cushions or decoration; likewise, changes in <\/span>the number of people or guests may be requested up to 2 days before the service, <\/span>changes requested 1 day in advance will not be considered by “THE PICNIC <\/span>COMPANY”\u00ae for organizational and logistical reasons.<\/span><\/p>\n The material used, as well as all components, decoration and accessories are property of <\/span>“THE PICNIC COMPANY”\u00ae, for which “THE CLIENT” under no circumstances may lease, <\/span>sell, assign or transfer by any means to third parties, otherwise, “THE CLIENT” shall pay <\/span>all damages caused by such acts to “THE PICNIC COMPANY”\u00ae .<\/span><\/p>\n “The CLIENT” undertakes to use the material with due care and respect, as well as not <\/span>to use it for any purpose other than exclusively for the contracted service, and it is <\/span>forbidden to make changes in the assembly, decoration or theme contracted.<\/span><\/p>\n “THE PICNIC COMPANY”\u00ae assumes no responsibility in case of accidents or injuries that <\/span>may arise during the service.<\/span><\/p>\n “THE PICNIC COMPANY”\u00ae assumes no responsibility for food intolerances or allergies.<\/span><\/p>\n Based on Article 220 of the General Health Law, which states: “In no case and in no way <\/span>may alcoholic beverages be sold or supplied to minors.” <\/span>In the case of adults, the consumption of alcohol is at their own risk and “THE PICNIC <\/span>COMPANY”\u00ae disclaims any eventuality or accident that may occur due to abuse in its <\/span>consumption.<\/span><\/p>\n Each contracted picnic includes a package of photographs according to the contracted <\/span>package: classic= 5 photographs; premium= 5 photographs; premium plus and <\/span>groups= 5-10 photographs; marriage proposal= 20 photographs. These will be captured <\/span>by our photographer and at the discretion of the same, will be chosen the best to deliver <\/span>to “THE CLIENT”, so being a courtesy gift, this has no in<\/span>\u2000<\/span>uence on their selection, <\/span>however, there is the possibility of hiring a photo shoot at additional cost.<\/span><\/p>\n In case of rain or bad weather due to storms, the client has the option to reschedule the <\/span>service up to 1 day before the contracted date, in case it is foreseeable by the National <\/span>Meteorological Service.<\/span><\/p>\n In the case of an unforeseen event, the service may be cancelled at any time and will be <\/span>rescheduled according to the availability of “THE PICNIC COMPANY”\u00ae agenda, without <\/span>the option of cancellation or refund.<\/span><\/p>\n Other tasks, such as special cleaning work, transportation tasks or decoration that has <\/span>not been contractually speci<\/span>\u2000<\/span>ed, will be paid extra depending on the e<\/span>\u2000<\/span>ort. <\/span>For events of 12 or more people, the rate increases $1,000.00 (one thousand pesos<\/span>\/100 Mexican pesos) due to the type of transportation required to transport the <\/span>furniture.<\/span><\/p>\n The <\/span>\u2000<\/span>oral arrangements that are included in the decoration of the contracted theme, <\/span>may not be modi<\/span>\u2000<\/span>ed or increased, in case of requiring additional <\/span>\u2000<\/span>ower service, this will <\/span>have an extra cost, depending on the quantity, type and availability.<\/span><\/p>\n The “PICNIC PREMIUM PLUS, MOVIE NIGHT ON THE BEACH” service, as its name <\/span>indicates, consists of the projection of a <\/span>\u2000<\/span>lm or cinematographic creation during the <\/span>event, said service is a courtesy without cost when hiring the aforementioned service, <\/span>therefore, it is to make clear that “THE PICNIC COMPANY”\u00ae does not have the <\/span>patrimonial rights of such <\/span>\u2000<\/span>lm productions, however, the same have been acquired <\/span>through streaming service prior to their respective payment subscription, so it is <\/span>considered for private use and non- pro<\/span>\u2000<\/span>t, not being included an extra fee for <\/span>reproduction to “THE CLIENT” and his guests, the above according to the Federal <\/span>Copyright Law and its articles relating to the total or partial reproduction of <\/span>cinematographic works for non-pro<\/span>\u2000<\/span>t purposes.<\/span><\/p>\n “THE PICNIC COMPANY”\u00ae is responsible for the use and protection of your personal <\/span>data, ensuring the use only for the contracted services, ensuring that at no time will be <\/span>shared with third parties, and that we do not collect sensitive information at all times <\/span>protecting your privacy and exclusivity, in accordance with the provisions of the Federal <\/span>Law on Protection of Personal Data Held by Private Parties.<\/span><\/p>\n We reserve the right to refuse service to any person, for any reason and at any time, as <\/span>well as to perform any work or extra time to the contracted.<\/span><\/p>\n We currently accept payments through bank transfers, Paypal and cash. In the case of <\/span>transfers and Paypal, “THE CLIENT” will be responsible for the charges applied by the <\/span>nancial institutions for such service. Also, in case of requiring invoice, the <\/span>corresponding VAT charge will be applied.<\/span><\/p>\n We have made the e<\/span>\u2000<\/span>ort to show the colors, images and assemblies of our services with <\/span>the highest possible color accuracy, as well as the structure, arrangement and quality of <\/span>the materials. We cannot guarantee that your computer monitor will display colors, <\/span>dimensions and approaches accurately.<\/span><\/p>\n Because the events are held on the beach, being a public place without access <\/span>restriction, we have no in<\/span>\u2000<\/span>uence on the volume of external music or people’s voices, <\/span>however we try to isolate the Picnic from others, as much as possible to ensure privacy <\/span>and tranquility, so we are not responsible for disturbances or noises that are not within <\/span>our reach.<\/span><\/p>\n If there is a cancellation by “THE CLIENT”on the same day of the event, he\/she will be <\/span>subject to a penalty of $1,000.00 (one thousand pesos 00\/100 national currency).<\/span><\/p>\n In the event that we make a change or cancel a service due to force majeure, directly <\/span>attributable to “THE PICNIC COMPANY”\u00ae, we will notify you immediately, giving you the <\/span>option to reschedule.<\/span><\/p>\n The service contract must be signed by the client prior to the event, as it implies the <\/span>express acceptance of the contracted service, as well as the present terms and <\/span>conditions, in the absence of such
